Interchange Fees: Supreme Court rejects Visa’s Request for Fine Carve-out
In June 2023, the Swiss Competition Commission (“ComCo”) opened an investigation into Visa’s domestic interchange fees for its debit cards. Visa requested ComCo to issue interim measures preserving it from fines for its domestic interchange fees set. Mastercard intervened in the proceedings. Both ComCo and the Federal Administrative Court rejected Visa’s request.
The Federal Supreme Court has now upheld ComCo’s decision.
